Welcome to Marcus. By downloading, installing, or using our application, you agree to be bound by these Terms of Use. Please review them carefully before proceeding.
1. Overview
Marcus is a private AI chat application designed to give you secure access to multiple leading AI models and a fully offline on-device model. The app is built with privacy at its core — your conversations are stored locally on your device and are not transmitted to or retained on our servers. Marcus serves as a secure intermediary between you and AI model providers, stripping identifying information before any request is forwarded.
2. Eligibility
You must be at least 18 years of age to use Marcus. If you are between 13 and 17 years of age, you may use Marcus only with the consent and direct supervision of a parent or legal guardian who has reviewed and agreed to these Terms. By using Marcus, you represent that you meet these eligibility requirements and have the legal capacity to enter into this agreement.
3. Privacy and Data Protection
Your privacy is fundamental to how Marcus operates. The app processes conversations locally on your device by default. When you use cloud-based AI models, we remove personal metadata before forwarding requests to model providers. We do not store your prompts or AI-generated responses on our servers. 4. AI-Generated Content
Marcus provides access to AI-generated responses for informational, creative, and entertainment purposes. AI outputs should not be treated as professional advice of any kind, including but not limited to medical, legal, financial, or therapeutic guidance. We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content. You are solely responsible for evaluating and acting upon information provided through the app. Always consult qualified professionals for decisions that affect your health, finances, legal standing, or other important matters.
5. Acceptable Use
You agree to use Marcus in compliance with all applicable laws and regulations. You must not use the app to generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable. You must not attempt to circumvent, disable, or interfere with the app's safety features or content moderation systems. You must not use Marcus to infringe upon the intellectual property rights of others, to engage in unauthorized data collection, or to distribute malware or other harmful code. Violation of these terms may result in restricted functionality or termination of your access to the service.
6. AI Model Provider Terms
When you use specific AI models through Marcus, your usage is also subject to the acceptable use policies of the respective model providers. These policies generally prohibit uses that are illegal, harmful, sexually explicit, or that fall within regulated domains. Marcus enforces these provider policies and may implement safety mechanisms that filter certain requests or responses to ensure compliance.
7. Intellectual Property
You retain all rights to the content you create and submit through Marcus, including your prompts and any original text you provide. AI-generated outputs are provided to you for your use, subject to the terms of the underlying model providers. The Marcus application, its design, branding, and underlying technology are the intellectual property of Marcus and are protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or reverse-engineer any part of the application without our express written permission.
8. Subscription and Payments
Marcus may offer free and premium subscription tiers. Premium features, pricing, and billing terms will be clearly presented before any purchase. Subscriptions are managed through the Apple App Store or Google Play Store, and are subject to the respective platform's terms and refund policies. We reserve the right to modify pricing or feature availability with reasonable notice to existing subscribers.
9. Limitation of Liability
Marcus is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, we disclaim all liability for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total liability for any claim related to the service shall not exceed the amount you paid for Marcus in the twelve months preceding the claim. This limitation applies regardless of the legal theory upon which the claim is based.
10. Service Availability
We strive to maintain consistent availability of Marcus and its features, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Cloud-based AI model availability depends on third-party providers and may be subject to their own service interruptions. The offline chat mode remains available regardless of network connectivity.
11. Modifications to Terms
We reserve the right to update or modify these Terms of Use at any time. Material changes will be communicated through the app or via other appropriate means before they take effect. Your continued use of Marcus after such changes constitutes your acceptance of the revised terms. If you do not agree with the updated terms, you should discontinue use of the application.
12. Governing Law
These Terms of Use shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from or relating to these terms or your use of Marcus shall be resolved through binding arbitration or in the courts of competent jurisdiction, as determined by applicable law.
